TERMS OF SERVICE — 01 VINYL RECORDS

OVERVIEW

Welcome to 01 Vinyl Records. These General Terms and Conditions of Sale and Use govern the use of our online store and all purchases made therein. By visiting our website or placing an order, you agree to be bound by these terms. If you do not accept them, please do not use our services. By accepting these terms, you confirm that you have reached the age of legal majority in your country of residence. Our store is hosted by Shopify Inc., which provides us with the e-commerce platform enabling us to sell our products to you.

ARTICLE 1 — ORDERS AND ACCOUNT

Any order placed on our store constitutes a purchase offer and remains subject to our written confirmation. You agree to provide accurate and up-to-date billing, payment and delivery information. We reserve the right to refuse, limit or cancel any order at our sole discretion (for example in the event of a prior dispute, concerns regarding the payment card, or out-of-stock items). You are solely responsible for the security of your account credentials. Furthermore, you represent and warrant that your purchases are intended for personal use and not for commercial resale. You are not authorized to transfer, sell, assign or sublicense your customer account to another person without our written consent. We reserve the right to suspend, disable or terminate your customer account and your access to our Services at any time and without notice if we determine that you are in breach of any provision of these terms or are engaging in fraudulent or harmful conduct toward our store.

ARTICLE 2 — PRODUCTS, DESCRIPTIONS AND VISUALS

We pay the utmost attention to the accuracy of our catalogue.

IMPORTANT: Each product listed on our store is accompanied by a specific and unique description, carefully written to faithfully reflect the actual and exact condition of the physical copy being sold (including its level of wear or grading). The visuals or photographs shown are mostly sourced from online databases (stock or generic images); only the written description is specific to the item and serves as the authoritative reference for certifying its actual condition. Actual photographs of the specific copy in stock can be provided upon simple request before your purchase — do not hesitate to ask. While we make every effort to display product images as accurately as possible, we cannot guarantee that the colour rendering on your computer or phone screen will be perfectly accurate. We reserve the right to limit the quantities of products we offer to any individual, geographical area or jurisdiction, on a case-by-case basis.

ARTICLE 3 — PRICES AND PAYMENT

Our product prices are subject to change without notice. Our prices are displayed and quoted exclusive of tax (VAT not applicable, Article 293 B of the French General Tax Code). Unless otherwise stated, they are exclusive of shipping costs and customs duties. Full payment is required at the time of order confirmation. You represent and warrant that you have the necessary rights to use the chosen payment method. You agree to promptly update your account, including your email address and payment method expiry details, so that we can complete your transactions without issue.

ARTICLE 4 — SHIPPING AND CUSTOMS

All delivery times indicated are estimates and are not guaranteed. International shipping may result in delivery delays or slower tracking updates due to customs clearance procedures that vary by country and whose duration we cannot predict. As an example, shipments to the United States may be subject to thorough inspection procedures by customs authorities (Customs and Border Protection — CBP).

Products ordered for delivery outside the European Union may be subject to customs duties and import taxes, levied when the parcel reaches its specified destination. You will be solely responsible for payment of these duties and import taxes. It is also your responsibility to manage any local pickup or specific delivery arrangements with your local postal or delivery service. 01 Vinyl Records has no control over these local fees and requirements. We invite you to contact your local authorities or post office for further information.

ARTICLE 5 — INTELLECTUAL PROPERTY

All content on this website (texts, logos, graphics, trademarks and proprietary images) is the exclusive property of 01 Vinyl Records or its licensors. Any unauthorized reproduction, distribution or use of these elements is strictly prohibited.

ARTICLE 6 — DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

Our products (in particular used records) are sold "as is," in accordance with their individual description. To the fullest extent permitted by law, 01 Vinyl Records, its officers and employees shall not be liable for any indirect damages, loss of profit, or harm arising from the use of the service or the purchase of products. In any event, our total liability is strictly capped at the exact amount paid by the customer for the order in question. You also hereby acknowledge that our technical platform provider Shopify shall not be held liable for any aspect of sales concluded between you and our store.

ARTICLE 7 — PROHIBITED USES AND SECURITY

You are strictly prohibited from using automated systems (bots, scraping tools, AI or data collection tools) to access or extract content from our store. Furthermore, you agree not to upload, transmit or distribute viruses, malicious code or any other technology that could compromise the security, integrity or proper functioning of our Services.

ARTICLE 8 — ERRORS, INACCURACIES AND OMISSIONS

Our website may occasionally contain information with typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions or shipping costs. We reserve the right to correct any error, modify or update information, or cancel orders in the event of inaccurate information, at any time and without notice (including after you have confirmed your order).

We reserve the right, at our sole discretion, to update or modify any part of these Terms by posting the changes on our website. It is your responsibility to review them periodically.
